Terms and conditions

In short: You can use your design for personal or business purposes, but you cannot resell the templates or underlying assets. Third-party assets may have their own licenses.

1. Our Service

We provide a free online design editor. You may edit templates, add text, change colors, and arrange elements. When you are satisfied with your design, you may purchase a download license.

2. What You Receive

After payment, you receive a ZIP file containing:

• One or more PNG files
• A JSON file containing your design configuration
• A text file listing all fonts used in your design
• A text file listing all color codes (HEX/RGB) used in your design

3. No Refund Policy — All Sales Final

Because you personally create your design using our editor, and because you receive the files instantly upon payment, we do not offer refunds for reasons including:

• You changed your mind
• You do not like how your design looks
• You found a mistake in your own text or choices
• You purchased the wrong file type
• You no longer need the design

The only exceptions:

• If the ZIP file we send you is corrupted or empty, we will provide a replacement file within 7 days.
• If we cannot provide a working replacement within 7 days, we will issue a full refund.

4. For Customers in the European Union

Under EU law, you normally have 14 days to withdraw from a distance contract. However, for digital content that is delivered instantly, your right of withdrawal ends once delivery begins — provided you give your explicit consent.

By clicking the checkbox at checkout and completing your payment, you:

1. Explicitly request immediate delivery of your digital files
2. Acknowledge that you lose your right of withdrawal
3. Confirm that you understand all sales are final

By proceeding with the purchase, you expressly consent to immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal.

5. "I Didn't Get My Files" — Resolution Process

If you complete payment and do not receive your download link within 15 minutes:

• Step 1: Check your spam/junk folder. Search for Biuse.
• Step 2: If still not received, contact us at support@biuse.app with your PayPal transaction ID.

We will verify your payment and either:

• Resend the download link, or
• Manually email you your ZIP file

We will not refund for "lost files" unless we cannot locate your transaction or provide a working replacement after 7 days (see Section 3).

6. PayPal Disputes

If you open a PayPal dispute for "Item Not Received" or "Not as Described," we will provide PayPal with:

• Proof that you created the design yourself using our editor
• Server logs showing you accessed the editor before payment
• Download logs (if you downloaded the file)

Fraudulent or abusive use of the dispute system may result in suspension or termination of your account. We may also report fraudulent disputes to PayPal.

7. What You May Do With Your Design

Important: Our editor uses icons and images from third-party sources (such as Pixabay, Iconify, and Iconduck, among others). These third-party sources are not affiliated with or endorsed by us. These third-party assets have their own licenses. You are responsible for complying with those licenses. This section only describes our license to you - it does not override any third-party license.

We do not guarantee that all third-party assets are free of rights restrictions. Some images or icons may be subject to trademark, copyright, or personality rights. You are solely responsible for ensuring that your use of any third-party asset complies with applicable laws and licenses.

When you purchase a download, we grant you a personal, non-exclusive, perpetual license. This license is non-transferable and non-sublicensable. You can:

• Use your PNG design for your own personal or business purposes (website, social media, print materials)
• Modify the PNG file further in other software
• You may use your design for commercial purposes, subject to third-party license restrictions.

The third-party assets (icons, images) in your design are governed by their original licenses, which generally permit the uses above. However:

• Some third-party assets may require attribution (credit to the creator). Where required, you are responsible for providing proper attribution in accordance with the asset's license.

8. What You May NOT Do

You may not:

• Resell, redistribute, or share the original unedited template assets (the base designs available in our editor)
• You may not extract and resell third-party assets as standalone files where such use is restricted by their original license.
• Claim ownership of the original third-party icons or images
• Use your design for illegal, hateful, defamatory, or obscene content
• Use our editor to generate content that infringes someone else's trademark or copyright

9. Our Rights and Your Ownership

We retain all copyright and ownership of the original template designs, editor software, and layout structures.

You own the specific creative choices you made (your text, color selections, element arrangement). This does not grant you ownership of the underlying templates or third-party assets.

The underlying third-party icons and images remain under their original licenses and are not "owned" by either party.

10. Indemnification (You Protect Us)

You agree to indemnify and hold us harmless from any claim, lawsuit, or demand arising from:

• Your violation of any third-party license (including Pixabay, Iconify, Iconduck or icon creators)
• Your use of an exported design in a way that infringes a trademark or copyright
• Your violation of these terms

This means if someone sues us because of something you did with your design, you agree to pay our legal costs and any judgment against us.

11. Limitation of Liability

Our total liability to you for any claim arising from your purchase is limited to the amount you paid for that purchase. We are not liable for any lost profits, business interruption, or other indirect damages.

11A. No Warranty

The service and all digital content are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the editor will be error-free, that designs will render identically across all devices or platforms, or that third-party assets will remain available.

12. Governing Law

These terms are governed by the laws of Lithuania. For EU customers, mandatory consumer protections in your home country also apply where they provide greater rights than these terms.
